Forever Chemicals – Per- and Polyfluoroalkyl (PFAS) substances – are a group of approximately 16,000 man-made chemicals, some of which have been in use since the 1940s. These chemicals resist heat, water, grease, and stains and are widely used precisely because they do not break down easily. They are found in non-stick cookware; water- and stain-resistant clothing; food packaging (wrappers, microwave popcorn bags); cosmetics and personal care products; carpets; upholstery; and cleaning products; and firefighting foam. Unfortunately, adverse health & environmental Impacts have been linked to PFAS resulting in the need for increasing regulation, treatment and clean-up requirements. Anticipated PFAS Regulations in wastewater are expected to cost NJ ratepayers between $24B and $60B in physical treatment plant upgrades and hundreds of millions annually in increased operations and maintenance costs. These costs do not include increased costs for treatment and disposal of the residual sludge and other costs necessary to address PFAS.

Currently, the District Court of NJ is reviewing a proposed settlement between the State of NJ, NJDEP, 3M and DuPont which proposes to release 3M and DuPont from liability related to their sale, marketing, distribution, use, or manufacture of PFAS in New Jersey. This podcast discusses the Covenant Not to Sue and Release provisions in the proposed settlements and the impact of this shift of substantial financial burdens to towns and ratepayers.
