Attorney Joseph J. Maraziti Jr., a longtime solid-waste counsel to Morris County, normally holds a dinner at the annual League of Municipalities Convention in Atlantic City, which is this week.
But not this year.
Given the poor economy, Maraziti says that his firm, Maraziti, Falcon and Healey of Short Hills, has made a $7,500 donation to the New Jersey Food Bank instead of holding a dinner for municipal officials. Good for him.

MARAZITI, FALCON & HEALEY DONATES TO THE NEW JERSEY FOOD BANK AND POSTPONES ITS ANNUAL DINNER.
Short Hills, NJ. - At a time when so many people are suffering as a result of the financial hardships being experienced by the thousands of individuals who have lost their jobs; at a time when so many public entities have been forced to make reductions in staff and services; at a time when meeting essential human needs is becoming increasingly difficult, we at Maraziti, Falcon & Healey have decided that it would not be appropriate to hold our Annual Dinner this year during the League of Municipalities Convention in Atlantic City.
Instead of holding the Annual Dinner this year, Maraziti, Falcon & Healey has made a donation of $7,500 to the New Jersey Food Bank. After much thought - given the long tradition of the Dinner - we decided to make a statement, not only to be sensitive to the current economic distress felt by so many, but also to provide much-needed support to the Food Bank at a time when its services are in great demand and its resources are so greatly stressed.
We hope and expect that the situation will be different next year so that we can in good conscience reestablish our long-standing practice.

Maraziti, Falcon & Healey, LLP, recently represented the Borough of Atlantic Highlands Board of Education in successful settlement negotiations with a party who is potentially responsible under the NJ Spill Compensation and Control Act for TCE contamination at the Atlantic Highlands Elementary School. In settlement of prior litigation between the Board and the potentially responsible party, Joseph J. Maraziti, Jr., and Christopher D. Miller helped the Board successfully negotiate for the potentially responsible party to install, at its cost, a “sub-slab depressurization system” at the school. The system is designed to monitor the indoor air quality of the school, and ensure the safety of the school building’s occupants.

PRESS RELEASE - STATE APPEALS COURT PUTS HOLD ON NJDEP WINTER WASTEWATER DISCHARGE REGULATIONS.
Trenton, NJ. - The New Jersey Department of Environmental Protection’s proposed regulations to limit phosphorus discharges in North Jersey Rivers during the winter months were put on hold by a New Jersey Appeals Court today, pending a hearing later this year.
The case argued before the Court on June 2nd, by Diane Alexander and Robert Goodsell involved phosphorus discharges from wastewater treatment facilities in the Passaic River Basin. The rule at issue affects 68 municipalities in Bergen; Morris; Passaic; Sussex; Essex; Somerset; and Union Counties.
The Court said that the DEP failed to make a sufficient case for the aspect of the new regulations that impose winter limitations and has ordered proceedings before an administrative law judge to be completed by January 29, 2010. The Appellate Court will, however, retain oversight of the case.
Diane Alexander, the attorney from Maraziti Falcon & Healey, the Short Hills firm representing three of the wastewater treatment facilities in Morris and Essex Counties, said the ruling represents hope for consumers who may be spared close to two million dollars each year in added chemical costs alone to reduce phosphorus levels in the region’s waterways during the winter months when studies have established that no environmental benefit will be realized.
“Our position has been that the DEP regulation, as written, would place an unnecessary, costly burden on wastewater treatment facilities that would ultimately be borne by residents and businesses to remove phosphorus when it is clearly unnecessary,” said Alexander.
